    3. As a general rule, each company in the MODIVO Group decides independently on the purposes and methods of processing personal data (“Personal Data”), which means that each company is a separate controller (“Controller”) – depending on the company you contact or enter into a contract with, generally, that company will be the controller of your Personal Data.
    4. The information contained in this document applies to each of the MODIVO Group companies to the extent that these companies are the Controllers, with MODIVO S.A. being the Controller for most of the processes within the MODIVO Group.
    5. MODIVO Group companies have a joint recruitment policy and jointly determine the purposes and methods of processing Personal Data of job applicants in the MODIVO Group and are joint controllers of Personal Data in this regard.
    6. It may also happen that a particular company performs activities for another MODIVO Group company, e.g. related to logistics, or marketing – in this case, however, the company performing this work does not become the Controller of your personal data, but processes it on the basis of the entrustment contract it has concluded with the Controller.
  2. Processing of Personal Data
    Your Personal Data may be processed in connection with a number of situations: (i) if you provide us with your Personal Data in person through various communication channels (e.g., by directing an inquiry/offer by email, telephone, or through a form on our websites); (ii) as part of our cooperation when signing or executing a contract; (iii) when we have obtained your Personal Data from other sources (e.g., from a company you work with that is our contractor/customer, including another MODIVO Group company).
    This information does not apply to the processing of Personal Data in connection with our Customers' use of eobuwie.pl online store and the conclusion of contracts through it – if you would like to obtain information on this subject, please refer to our Privacy Policy.
  3. Processing of Personal Data in connection with Recruitment
    Since, within the MODIVO Group, the companies that make up the Group have a common recruitment policy, they are joint controllers of your Personal Data as job applicants in this regard.
    In order to properly fulfil the obligations set forth in Article 26 of the GDPR, the aforementioned companies, as joint controllers, have defined their respective responsibilities regarding the fulfilment of their obligations under the GDPR.     1. Scope of Personal Data Processed
      We process the Personal Data of job applicants submitted through all available recruitment channels.
      In connection with recruitment, we may process the following Personal Data (processing of some Personal Data may depend on your consent): identification data, contact details, educational data, data on skills and previous employment, data on entitlements and other Personal Data provided to us during the recruitment process.
    2. Purpose and Basis of Processing
      In connection with recruitment, we process your Personal Data for the purposes necessary for the current recruitment process at MODIVO Group and, if you consent, for future recruitment processes for similar positions.
      The basis for the processing of your Personal Data is to take action at the request of the data subject prior to the conclusion of a contract, the provisions of applicable law (in particular, the Labour Code and secondary legislation), and to a greater extent than specified in these provisions or for future recruitment processes, depending on your consent.
      If you have given any of the above-mentioned consents, you may withdraw them at any time - however, this will not affect the lawfulness of the processing we perform before the withdrawal.
      We will also process your Personal Data for purposes related to the potential possibility of disputes between you and any of the joint controllers (the legal basis for processing in such case is the legitimate interest of the controller). We may also process your Personal Data for marketing purposes of joint controllers or their partners related to recruitment activities. In this case, the legal basis for processing is the legitimate interest of the data controller or a third party (the own marketing of joint controllers or partners).
      Provision of Personal Data is voluntary but necessary to carry out the recruitment process and to establish possible further cooperation.
    3. Period of Personal Data Processing
      We will, as a general rule, process your Personal Data for the duration of the recruitment process or, depending on your additional voluntary consent for future recruitment, for a period of 12 months from the moment of your consent, or until you withdraw your consent, and in the case of marketing activities, until you object, whereby they will be deleted in any case after the expiration of the relevant time period unless the law obliges us to process the data longer, or we will store them longer in case of potential claims, for the term of their limitation period set by law, in particular, the Labour Code or the Civil Code.

    1. Purpose and Basis of Processing
      Your Personal Data, including that provided in connection with subscribing to the MODIVO Career Site Newsletter, is or may be processed for the following purposes:
      • performance of the contract for the provision of the MODIVO Career Site Newsletter – legal basis: Article 6(1)(b) of the GDPR, i.e. necessity for the performance of the concluded contract (Service Regulations of the MODIVO Career Site Newsletter) – in order to send you, e.g. by e-mail or via SMS, MMS, push messages or communicators having analogous use for you that are assigned directly to your phone number (e.g. Messenger, WhatsApp), as well as attractive advertisements and offers). Of course, you can unsubscribe from the newsletter at any time.
      • marketing, analytical and statistical activities of the Controller or its partners (third parties listed in the item 11 of the Cookies Policy) or other so-called third parties with whom we cooperate, so that we can better adapt to certain general groups of our Customers. However, our actions do not materially affect your decisions – legal basis: Article 6(1)(f) of the GDPR, i.e. the legitimate interest of the Controller or a third party;
      • establishing, defending and asserting claims that may arise within the framework of the relationship between you and the Controller, as well as other purposes that are necessary to pursue the legitimate interests of the Controller or a third party – legal basis: Article 6(1)(f) of the GDPR, i.e. legitimate interests pursued by the Controller or a third party.
      Providing Personal Data is voluntary, but necessary to subscribe to the MODIVO Career Site Newsletter.
    2. Period of Personal Data Processing
      We will process your data for the period necessary for the performance of the contract (unsubscribing from the newsletter), until you lodge an objection, as well as for the time required by law, unless a longer period is due to their storage in case of possible claims for the limitation period specified by law, in particular, the Civil Code, or for other purposes arising from the implementation of our legitimate interests. In any case, the longer term of storage of Personal Data is decisive.
  5. Recipients of Personal Data
    Your Data may be transferred to entities that help us communicate with our contractors and customers (e.g., support us in sending e-mails and, in the case of advertising activities, also in marketing campaigns), help us run our website and application, provide support and operation of our ICT tools and systems (e.g. data storage), as well as to delivery companies, payment processors (online payment operators or banks), and provide ongoing legal services, conduct audits, etc., including, as part of the above activities, to other MODIVO Group companies. In the case of recruitment, your Personal Data may also be transferred to entities that technically or organizationally help us conduct employee recruitment, including communication with candidates.
  6. Transfer of Personal Data outside the European Economic Area (EEA)
    We may exceptionally transfer your Personal Data to our processing partners outside the European Economic Area (EEA), but only to the extent necessary, that is related to the provision of services, especially IT services (e.g., cloud storage), by these partners for us. The security of your Personal Data is ensured by the safeguards we use, including standard contractual clauses approved by the European Commission and personal data processing entrustment contracts that meet the requirements of the GDPR. When transferring data to countries outside the EEA, we make every effort to ensure that our partners provide an adequate level of protection by taking additional data security safeguards. You have the right to obtain a copy of the safeguards we apply to the transfer of data to countries outside the EEA, in particular, by contacting our data protection officer.
  7. Entitlements
    In any case, you have the right to:

    1. access to Personal Data (including, for example, receiving information on what Personal Data is processed);
    2. request rectification and restriction of processing of Personal Data (e.g., if incorrect);
    3. delete Personal Data (e.g., if it was processed unlawfully);
    4. transfer Personal Data that you have provided to the Controller and that is processed by automated means wherein the processing is based on consent or under contract, e.g. to another controller;
    5. object to the processing of Personal Data based on the premise of necessity for the purposes of legitimate interests pursued by the Controller or by a third party, including, in particular, to processing for marketing purposes;
    6. lodge a complaint with the President of the Personal Data Protection Office, ul. Stawki 2, 00-193 Warsaw.
    If the processing of Personal Data is based on consent, you have the right to withdraw it at any time without affecting the lawfulness of the processing carried out on the basis of consent before its withdrawal.
